AGA TECH does not record calls, meetings, or interviews without providing notice or obtaining consent where required by applicable law.

During later stages of employment, onboarding, payroll, contractor engagement, compliance, accommodation, or background-screening processes, we may collect limited categories of sensitive information, such as:

We generally do not request this information through ordinary website contact forms. Please do not send highly sensitive information unless AGA TECH has requested it through an appropriate process.

We use sensitive information only for purposes reasonably necessary to provide requested services, administer employment or contractor relationships, comply with legal obligations, protect individuals and systems, or perform other purposes permitted by law.

You may unsubscribe from marketing emails at any time. Unsubscribing from marketing will not stop application-related, staffing-related, contractual, security, legal, or service communications.

Legal and Corporate Purposes

  • Comply with applicable laws, regulations, subpoenas, court orders, and government requests;
  • Establish, exercise, or defend legal claims;
  • Investigate suspected fraud or misconduct;
  • Conduct audits and compliance reviews;
  • Respond to privacy or legal requests;
  • Support a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction; and
  • Protect the rights, safety, and property of AGA TECH and others.

4. Artificial Intelligence and Automated Tools

AGA TECH may use artificial-intelligence-assisted, machine-learning, analytics, matching, automation, or similar technologies to support activities such as:

  • Candidate sourcing and search;
  • Identification of potentially relevant skills and experience;
  • Candidate-to-opportunity matching;
  • Résumé organization or summarization;
  • Drafting communications;
  • Administrative workflows;
  • Research and data organization;
  • Fraud, security, or duplicate-record detection;
  • Website analytics; and
  • Development or delivery of consulting services.

These tools may process professional, candidate, business-contact, website, and communication information.

AGA TECH does not intentionally use artificial-intelligence tools to make final employment or placement decisions without appropriate human involvement. Recruiters, clients, hiring managers, or other authorized professionals review relevant information and remain responsible for employment and engagement decisions.

We do not intentionally input Social Security numbers, financial-account credentials, medical records, or similarly sensitive information into general-purpose public artificial-intelligence systems.

As California and other states adopt specific rules governing automated decision-making technology used in employment contexts, AGA TECH will update this section and provide any additional notices, opt-out options, or appeal rights required by applicable law before such rules take effect.

5. How We Disclose Personal Information

We may disclose Personal Information to the following categories of recipients for the purposes described in this Policy.

A. Clients and Prospective Employers

We may disclose candidate information to clients, prospective employers, hiring managers, interviewers, and authorized representatives to evaluate a candidate for an opportunity.

Information disclosed may include a résumé, professional history, skills, education, credentials, availability, compensation expectations, work-location preferences, work-authorization status, recruiter notes, and other relevant information.

We seek to present candidates in a manner consistent with the candidate’s interests, instructions, or reasonable expectations within the recruiting relationship.

B. Service Providers and Contractors

We may disclose information to providers that support:

  • Website hosting and maintenance;
  • Email and business communications;
  • Cloud storage;
  • Applicant tracking and customer relationship management;
  • Recruiting and talent sourcing;
  • Scheduling and video conferencing;

  • Payroll, benefits, accounting, and tax administration;

6. Sale and Sharing of Personal Information

AGA TECH does not sell Personal Information for monetary payment.

AGA TECH may use analytics, advertising, social-media, or similar digital technologies. Under certain state privacy laws, disclosure of online identifiers and browsing activity to advertising or analytics partners may be considered a “sale,” “sharing,” or use for targeted or cross-context behavioral advertising, even when no money is exchanged.

Where required by applicable law, you may opt out through:

  • A Your Privacy Choices or Do Not Sell or Share My Personal Information link, if displayed;
  • An enabled, legally recognized browser opt-out preference signal such as Global Privacy Control; or

AGA TECH does not knowingly sell or share the Personal Information of individuals under 16 years of age.

Where European Economic Area or United Kingdom data-protection law applies, we may process Personal Information based on:

Legitimate interests may include recruiting and matching candidates, responding to inquiries, operating and securing our business, maintaining business relationships, improving our services, preventing fraud, and conducting appropriate business marketing.

You may withdraw consent where processing is based on consent. Withdrawal does not affect processing lawfully conducted before withdrawal.

9. International Data Transfers

AGA TECH is based in the United States. We may also work with clients, candidates, partners, and service providers in other countries.

Personal Information may be processed in the United States and other jurisdictions whose privacy laws may differ from those in your location.

Where required, we use legally recognized safeguards for international transfers, which may include contractual protections, data-processing agreements, Standard Contractual Clauses, or other authorized mechanisms.

10. Data Retention

AGA TECH retains Personal Information only for as long as reasonably necessary for the purposes described in this Policy, including recruiting, staffing, employment, contractor management, client service, compliance, dispute resolution, security, and legal purposes.

Retention is determined based on:

  • The nature and sensitivity of the information;
  • The duration of the candidate, employment, contractor, client, or business relationship;
  • Whether a candidate remains interested in future opportunities;
  • Applicable statutes of limitation;
  • Employment, tax, payroll, accounting, immigration, and recordkeeping requirements;
  • Client or contractual requirements;
  • The need to establish, exercise, or defend legal claims;
  • Security and fraud-prevention needs; and
  • Whether deletion has been requested and an exception applies.

Candidate and recruiting information may be retained after a particular opportunity closes so that we can consider the individual for future opportunities, maintain records of submissions and communications, comply with legal obligations, and resolve potential disputes.

We may retain a minimal record of an opt-out, deletion request, suppression request, or other privacy choice to ensure that the choice continues to be honored.

When information is no longer reasonably necessary, we take steps to delete, anonymize, or securely dispose of it, subject to applicable legal and operational limitations.

11. Data Security

AGA TECH uses reasonable administrative, technical, and organizational safeguards designed to protect Personal Information against unauthorized access, loss, misuse, alteration, or disclosure.

These measures may include:

  • Access controls;
  • Password and authentication requirements;
  • Secure business systems;
  • Encryption where appropriate;
  • Vendor review;
  • Employee and contractor confidentiality requirements;
  • Security monitoring;
  • Data-minimization practices;

No website, email system, storage platform, or transmission method is completely secure. We cannot guarantee absolute security.

You are responsible for using appropriate caution when sending information electronically and for protecting your devices, passwords, and accounts.

12. Background Checks and Consumer Reports

When applicable to a position or assignment, AGA TECH or a client may request a background check, employment verification, credential verification, or other screening through an authorized consumer reporting agency or investigative consumer reporting agency.

Such screening is subject to the federal Fair Credit Reporting Act (“FCRA”) and, where applicable, the California Investigative Consumer Reporting Agencies Act (“ICRAA”), the California Consumer Credit Reporting Agencies Act (“CCRAA”), and other applicable state law, including state laws governing the use of criminal history in employment decisions.

Before a consumer report or investigative consumer report is obtained, you will be provided with a clear and conspicuous disclosure in a document consisting solely of that disclosure, and your written authorization will be obtained. This disclosure and authorization is separate from this Privacy Policy and from any employment application, onboarding paperwork, or other document.

13. Your Privacy Rights

Depending on your location and applicable law, you may have the right to:

  • Request access to Personal Information held about you;
  • Request information concerning how we collect, use, or disclose Personal Information;
  • Request correction of inaccurate Personal Information;
  • Request deletion of Personal Information;
  • Request a portable copy of certain Personal Information;

14. Other U.S. State Privacy Rights

Residents of certain other U.S. states may have rights under their state’s consumer privacy law. Many of these laws ; including Virginia’s Consumer Data Protection Act, Colorado’s Privacy Act, and comparable statutes in a number of other states ; generally exclude personal information collected about an individual acting in a commercial or employment context, including as a job applicant, employee, or independent contractor performing services in that capacity. As a result, most of the candidate, employment, and business-contact information AGA TECH processes falls outside the scope of these laws in the majority of states.

Where a state’s law does apply to our processing of your Personal Information ; for example, if your state’s law does not include an employment-context exclusion, or if you interact with us other than as a job applicant, employee, contractor, or business contact ; you may have rights similar to those described in this Policy. Depending on the applicable law, these rights may include the right to access, correct, delete, or obtain a portable copy of your Personal Information, and the right to opt out of certain processing, including targeted advertising or the sale or sharing of Personal Information.

Where required by applicable law, AGA TECH will honor a recognized universal opt-out preference signal, such as Global Privacy Control, as a valid request to opt out of covered sale, sharing, or targeted-advertising activity for the browser or device transmitting the signal.

To submit a request under an applicable state law, use the contact methods described in Section 15 (How to Submit a Privacy Request) below. We will evaluate and respond to requests in accordance with the law that applies to you.

State privacy laws are changing rapidly, and new states continue to enact or amend comprehensive privacy statutes. AGA TECH reviews this section periodically and will update it as applicable law or our processing activities change.

We will respond within the time required by applicable law.

16. Third-Party Websites and Platforms

Our website may link to client websites, job boards, professional networks, social-media platforms, scheduling tools, application platforms, or other third-party services.

AGA TECH does not control the privacy, security, or data practices of third parties. This Policy does not apply to information collected independently by those parties.

You should review the privacy policy of each third-party website or service before providing Personal Information.

17. Children’s Privacy

AGA TECH’s website and Services are intended for business professionals, clients, candidates, and adults seeking employment or business services.

Our Services are not directed to children under 16, and we do not knowingly collect Personal Information from children under 16 through the website.

Certain legitimate employment, internship, apprenticeship, work-permit, or similar programs may involve individuals under 18. In those circumstances, AGA TECH will handle information in accordance with applicable employment, consent, and privacy requirements.

We may update this Privacy Policy to reflect changes in our Services, technology, business practices, or legal obligations.

  • The purposes for collection, use, sale, or sharing;
  • The categories of third parties to whom information was disclosed;
  • Specific pieces of Personal Information;
  • Correction of inaccurate information;
  • Deletion of Personal Information;
  • A portable copy of certain Personal Information;
  • Opt-out of sale or sharing;
  • Limitation of certain uses or disclosures of sensitive Personal Information; and
  • Information concerning automated decision-making where applicable.

California residents also have the right not to receive discriminatory treatment for exercising applicable privacy rights.

7. Requests to Know, Correct, or Delete

We may verify a request by matching information supplied with information maintained by AGA TECH. The amount of verification required will depend on the type and sensitivity of the request.

We may retain or deny deletion of information where permitted by law, including where needed to:

  • Complete a transaction or provide a requested service;
  • Maintain employment, payroll, tax, immigration, or contractual records;
  • Detect or prevent security incidents or fraud;
  • Exercise free-speech or other legal rights;
  • Comply with law;
  • Conduct certain internal uses reasonably aligned with expectations; or
  • Establish, exercise, or defend legal claims.

8. Global Privacy Control

Where required by applicable law, AGA TECH processes a recognized Global Privacy Control or qualifying opt-out preference signal as a request to opt out of sale or sharing for the browser or device transmitting the signal.

A signal may not identify you by name or apply across other browsers, devices, or accounts unless the law requires and we can reasonably connect the request.

9. Authorized Agents

A California resident may authorize an agent to submit a request where permitted by law.

We may require:

  • Written authorization;
  • Proof that the agent is registered or otherwise authorized where required;
  • Direct verification of the resident’s identity; and
  • Confirmation that the resident gave the agent permission to act.

10. Retention

We retain each category of Personal Information only for as long as reasonably necessary for the disclosed purposes, using the criteria described in Section 10 of the general Privacy Policy.

Sensitive information is not retained longer than reasonably necessary for the purpose for which it was collected, subject to legal, contractual, security, and recordkeeping requirements.

11. California “Shine the Light”

California Civil Code Section 1798.83 permits certain California residents to request information regarding disclosure of certain personal information to third parties for their own direct-marketing purposes.

AGA TECH does not disclose Personal Information to third parties for those third parties’ own direct marketing in a manner that would require reporting under this law.
